The following terms and conditions are applicable to the customers use of myWindTurbine.com
EMD International A/S ("EMD","us", "we", or "our") operate the myWindTurbine.com website (the "Service").

Through this agreement the customer will be able to assess the feasibility of installing a domestic turbine and to monitor existing turbines.
All prices are daily prices and only applicable at the time of purchase. The buyer will be charged the price applicable at the time of purchase. All prices shown are VAT included.
myWindTurbine.com do not sell or dispatch any physical items. All items are electronical and are delivered through electronic distribution (internet) as a service. myWindTurbine.com gives the customer online access to a tool for assessing the feasibility of domestic turbines. The purchaser is required to save login information, and myWindTurbine is not required to compensate purchaser in case he/she forgets the login-information in relation to the purchase. As soon as EMD has received the customer’s confirmation, the delivery of the service immediately begins, and the project started. EMD takes no responsibility for problems in the delivery or delays caused by the customer or the customer’s equipment or other equipment not owned by EMD or the Technical University of Denmark - DTU Risø.
Your credit card infomation are encrypted and handled by ePay in order to secure you and your information. As soon as the payment has been authorized, the digital delivery starts and the money will immediately be reserved on your credit card.
Products ordered via myWindTurbine.com are classified as online digital content or specially manufactured items, as license keys are generated specifically to the purchaser. These keys can therefore not be returned and reused by another user. At the time of purchase, the service is immediately delivered and the customer thereby waives his right to cancel the purchase within 14 days. At order confirmation, myWindTurbine.com explicitly informs the customer that he/she is waiving his/her cancellation rights.
Complaints must be given with fair notice. In connection to a complaint, the customer is asked to describe when and where the fault occurs. This can be done with screen dumps or similar. The customer solely carries the responsibility for having sufficient equipment to run the services provided on myWindTurbine.com.
Disclaimer of warranty
The software is provided "as is", without warranty of any kind, expressed or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and noninfringement. In no event shall the EMD be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software. The software and generated results cannot replace technical consultancy, and must be confirmed by the user. The software and generated results are not guaranteed as precise data or analyses. EMD does not guarantee the software will fulfill your needs, or that the service will be without interruptions or without mistakes.
Limitation of liability
In the scope that it is not illegal by law, EMD is under no circumstances accountable for any direct, special, indirect damages, or collateral damages including, but not limited to, material damages, claims in relation to losses of savings, income or data by using the software.
We guarantee the service will be available for at least 1 year after the latest Prospector project has been purchased. An account created in myWindTurbine.com is personal, non-transferable and must not be shared with others. If an account is used unfairly, we reserve the right to limit access to the site.
EMD strives to have as high an uptime as possible. However, a specific uptime cannot be guaranteed due to the nature of the internet. To continuously secure a high uptime, EMD regularly maintains and updates the used hardware and software. During this maintenance, service may not be available for a shorter period.
Any dispute arising in connection with these terms, and that can not be solved amicably, will be settled by Danish law. The buyer has the opportunity to turn to https://webgate.ec.europa.eu/odr
